Avoiding Jail for Serious Family Violence Charges – Colac Magistrates’ Court

Our 36-year-old client facing extremely serious family violence charges including non-fatal strangulation and intentionally causing injury avoided imprisonment at Colac Magistrates’ Court, receiving a treatment-only Community Corrections Order. Despite allegations typically resulting in jail time even for first-time offenders, comprehensive preparation and rehabilitation focus secured community-based treatment over incarceration.

Case Overview

Charge: Family Violence Charges

Client: 36-year-old male client

Court Location: Colac Magistrates’ Court

At Elbob & Stephenson Legal, we recently secured an exceptional result for a 36-year-old male client who appeared before the Colac Magistrates’ Court facing extremely serious family violence charges, including:

  • Intentionally Causing Injury
  • Recklessly Causing Injury, and
  • Non-Fatal Strangulation (a recently introduced and highly serious offence in Victoria)

The allegations were particularly confronting and involved claims that our client had strangled the victim and stomped on her neck during a domestic incident. These are charges that, if proven, would almost always result in a term of imprisonment, even for a first-time offender.

From the moment we were engaged, our criminal defence lawyers worked swiftly and thoroughly to prepare the case. We:

  • Obtained a comprehensive material to support our submissions
  • Engaged in proactive negotiations with the prosecution
  • Highlighted our client’s genuine remorse, commitment to rehabilitation, and family and employment ties
  • Emphasised the rehabilitative prospects that could be achieved through community-based treatment

Despite the gravity of the offending, the Court was ultimately persuaded to impose a Community Corrections Order (CCO) with a treatment-only condition, and importantly:

  • No jail time was imposed, and
  • Our client was able to remain in the community and continue his treatment and rehabilitation

This was a remarkable result, especially given the serious nature of the charges and the current sentencing trends for non-fatal strangulation in Victoria.

If you or someone you know is facing family violence allegations, including charges like non-fatal strangulation, intentional injury, or reckless injury, it’s vital to have experienced legal representation from the outset.
