Our solicitor Mr Elbob made an appearance on behalf of a male in his mid-twenties at the Broadmeadows Magistrates Court. The Accused was charged with intentionally causing injury, recklessly causing injury and committing an indictable offence whilst on bail.
The case involved an incident, whereby it was alleged that our client physically assaulted his former partner and caused a fracture to her ribs.
Upon considering the brief of evidence and our clients instructions, Mr Elbob engaged in a summary case conference with the Prosecution and raised an argument as to self-defence, and that our client’s actions did not cause the injuries to the Complainant. In his representations to the Prosecution, Mr Elbob submitted that the Complainant in the matter had been acting erratic, had consumed significant amounts of alcohol, had also been involved in a physical altercation with another individual and that there was a significant question as to whether our clients actions caused the alleged injury to the Complainant.
Following the conference, the Prosecution agreed to withdraw the charges against our client provided that he did not make an application for costs against Victoria Police.
This result was achieved by preparing the case thoroughly. Mr Elbob paid careful attention to our clients version of events and to the surrounding circumstances of the alleged offending.
