Our client was charged with drug driving after testing positive for methamphetamine while behind the wheel. She had a similar offence on her record from just 18 months prior, raising serious concerns about recidivism and the risk of a jail sentence.
Upon obtaining a full background history, we discovered she had been battling long-standing trauma, a recent ADHD diagnosis, and was self-medicating. We immediately referred her for drug counselling and obtained a medical report outlining her mental health challenges and treatment plan. Her efforts in rehabilitation and willingness to participate in a behavioural change program were key to our submissions.
The court accepted our submissions that incarceration would be counterproductive and that rehabilitation was well underway. The client was placed on a Community Corrections Order with treatment conditions and avoided a term of imprisonment.
