Korumburra Magistrates’ Court – Fine Only for Repeat Driving Offences

EAS Legal represented a male client at the Korumburra Magistrates’ Court who faced multiple driving-related offences and had a significant prior history for similar offending. Due to the seriousness of the charges and his record, the client was at real risk of receiving a term of imprisonment. After preparing detailed submissions addressing the circumstances of the offending and the client’s personal situation, EAS Legal successfully persuaded the Court that a custodial sentence was unnecessary. The Court ultimately imposed a fine only, with no term of imprisonment.

Case Overview

Charge: Repeat Driving Offences

Client: Anonymous male client

Court Location: Korumburra Magistrates’ Court

At EAS Legal, we recently represented a male client before the Korumburra Magistrates’ Court who was facing multiple serious driving-related charges.

The matter was particularly challenging as our client had an extensive prior history for similar offending. Given the client’s record and the nature of the charges, the case was squarely within the range where a term of imprisonment could be imposed.

Understandably, our client was facing a very real risk of being sentenced to immediate custody.

Our Approach

Our office carefully reviewed the circumstances of the offending and prepared detailed submissions addressing the broader context of the matter. We focused on presenting the Court with a clear and balanced picture of our client’s personal circumstances and the steps taken since the offending.

Through strategic advocacy, we emphasised that the purposes of sentencing could be appropriately met without the need to impose a custodial sentence.

The Outcome

Following our submissions, the Court ultimately imposed:

  • A fine only
  • No term of imprisonment

This was an excellent result in circumstances where the client’s prior history and the nature of the offending placed him at significant risk of custody.
