Sexual Assault Allegation Withdrawn After Cross-Examination

Focused case preparation and effective cross-examination result in mid-hearing withdrawal of workplace sexual assault charges, preserving client’s clean record and employment at Dandenong Magistrates’ Court.

Case Overview

Charge: Sexual Assault

Client: 35-year-old male

Court Location: Dandenong Magistrates’ Court

Our client was accused of inappropriately touching a co-worker at a work function. The allegations led to him being stood down from his employment and a great deal of stress. He denied the allegations, insisting that any contact had been incidental and non-sexual.

We prepared a thorough cross-examination plan and subpoenaed workplace text messages and internal HR reports that raised concerns about the complainant’s credibility and potential motive. At the contested hearing, inconsistencies in the complainant’s account were exposed under cross-examination.

The prosecution withdrew the charge midway through the hearing. Our client’s record remained clean, and he was reinstated at work shortly after.

This strong result came from focused case theory development, excellent courtroom advocacy, and firm client support by Elbob & Stephenson Legal.
