A 39-year-old female instructed EAS Legal after being charged with Common Assault (Domestic Violence Related) following an argument with her former partner.
Our client consistently maintained that she had acted in self-defence and instructed us that important witnesses had not been spoken to by police. We obtained additional witness material and provided detailed representations to the prosecution highlighting significant evidentiary issues and inconsistencies within the complainant’s account.
Outcome: Following a review of the evidence, the prosecution withdrew all criminal charges prior to the hearing, allowing our client to move forward without a criminal conviction or the stress of contested proceedings.
