A 32-year-old male engaged EAS Legal after being charged with driving whilst suspended and various other driving offences. Importantly, our client also had a relevant prior history, making the sentencing exercise considerably more difficult.
The prosecution sought an extended period of licence loss, which would have created significant further consequences for our client. We prepared the plea carefully and made focused submissions addressing his circumstances, the offending, his prior history and why further licence loss was unnecessary.
Despite the relevant priors and the prosecution seeking additional disqualification, our client received a fine without conviction and, importantly, no further licence loss.
For our client, retaining his licence was the most important part of the outcome — and our submissions were directed accordingly.
