At EAS Legal, we recently represented a young driver at the Gosford Local Court who was facing sentence for driving with a special range Prescribed Concentration of Alcohol (PCA) while on his P plates.
The matter was particularly challenging because our client had a prior mid-range PCA conviction, making his previous history highly relevant to the Court’s consideration of the appropriate penalty.
Importantly, our client relied on his ability to drive for employment, meaning a lengthy period off the road had the potential to significantly affect his ability to work.

We prepared and presented strong subjective material in support of our client and made detailed submissions seeking the most favourable licence outcome available.
We also emphasised the period our client had already spent unable to drive and the practical importance of retaining his licence for employment.
The Outcome
The Gosford Local Court accepted our submissions and imposed the minimum disqualification period of just one month, together with a fine.
The result meant:
For a young P-plate driver appearing with a previous mid-range PCA conviction, securing the minimum period of disqualification represented an excellent result.
Why This Result Matters
A prior drink driving conviction can make a subsequent PCA matter considerably more difficult, particularly for a young driver.
This case demonstrates the importance of proper preparation for a plea and strong sentencing advocacy. The penalty is not determined by the charge alone—the quality of the material placed before the Court and the way a client’s circumstances are presented can make a significant difference.
For our client, the outcome meant just one further month of disqualification, allowing him to return to the road and continue working.
