Melbourne Magistrates’ Court – Intervention Order Conditions Successfully Negotiated to Allow Ongoing Family Contact

A 36-year-old woman instructed EAS Legal after an application for a Family Violence Intervention Order was issued following allegations arising from a family dispute. While she strongly disputed many of the allegations, her main concern was ensuring any final outcome would still allow ongoing communication about elderly family members and attendance at important family events, without the risk of breaching an order.

Case Overview

Melbourne Magistrates Court

Charge: Drug Charges

Client: 36-year-old female

A 36-year-old female instructed EAS Legal after an application for a Family Violence Intervention Order (FVIO) was issued following allegations arising from a family dispute.

While our client strongly disputed many of the allegations, her primary concern was ensuring that any final outcome would allow ongoing communication regarding elderly family members and attendance at important family events without the risk of breaching an intervention order.

Rather than allowing the matter to progress unnecessarily towards a contested hearing, we entered into detailed negotiations with the applicant’s legal representatives, carefully addressing the practical issues that would arise if the proposed conditions remained unchanged.

Through strategic negotiations, we were able to reach an agreement that significantly reduced the proposed restrictions while still addressing the concerns raised by the applicant.

The Court made a final Intervention Order with substantially amended conditions, allowing our client to continue important family communication and attend agreed family occasions while avoiding the uncertainty, cost and stress of a contested hearing.
