Melbourne Magistrates’ Court – No Conviction for Repeat High-Range Drink Driving Offender

At EAS Legal, we recently represented a 50-year-old male client before the Melbourne Magistrates’ Court who was charged with serious driving offences, including:

  • High-Range Driving Under the Influence (DUI); and
  • Driving Without a Licence.

This was a particularly challenging matter due to our client’s significant history of similar offending. Given his prior record and the seriousness of the charges, there was a real risk that the Court would impose a substantial penalty, including a criminal conviction and a significantly higher financial penalty.

Our client had previously been represented by another law firm for similar offending and had received a more severe sentence.

Our Approach

From the outset, our office undertook a comprehensive review of the matter and carefully prepared sentencing submissions aimed at achieving the best possible outcome.

We focused on:

  • Our client’s personal circumstances and insight into his offending;
  • The progress he had made since the offences occurred;
  • The impact that a conviction would have on his future; and
  • Why the purposes of sentencing could be achieved without the recording of a conviction.

Our strategy was to present the Court with a balanced picture of the client, demonstrating that despite his history, a further punitive outcome was not necessary to achieve justice.

The Outcome

Following our submissions, the Court imposed:

  • A fine of just $900
  • No conviction recorded

This was an exceptional result given:

  • The seriousness of the offences;
  • The client’s extensive prior history for similar offending; and
  • The fact that the sentence imposed was more lenient than the penalty our client had received for his previous offending when represented by another firm.

Why This Result Matters

Repeat drink driving and licensing offences are treated very seriously by Victorian courts, particularly where a client has an established history of similar offending.

This case demonstrates that past history does not automatically determine future outcomes. With careful preparation, strategic advocacy, and a thorough understanding of sentencing principles, it is possible to achieve significantly better results—even in matters where the prospects initially appear challenging.
