A 28-year-old male sought assistance from EAS Legal after being charged with common assault and assault occasioning actual bodily harm following an altercation.
Our client disputed significant parts of the allegations. A detailed review of the brief identified inconsistencies between the complainant’s account, independent witness evidence and other material relied upon by the prosecution.
We prepared targeted representations challenging the evidentiary basis of the charges and sought an early review of the prosecution case.
Following further negotiations, the prosecution agreed to withdraw both assault charges, bringing the proceedings to an end without the need for a defended hearing.
