A 34-year-old female instructed EAS Legal after being charged with Supply Prohibited Drug, Possess Prohibited Drug and Deal with Property Suspected of Being Proceeds of Crime following a police investigation into alleged street-level drug supply.
The prosecution relied on mobile telephone material, cash located during the execution of a search warrant and admissions allegedly made during the investigation. Given the seriousness of the offending and our client’s prior criminal history, the matter carried a real risk of full-time imprisonment.
Our team undertook extensive preparation before sentence, obtaining evidence of our client’s rehabilitation, engagement with drug and alcohol treatment, stable employment and strong community support. We also negotiated with the prosecution to refine the agreed facts, ensuring the offending accurately reflected our client’s role and level of criminality.
Detailed written submissions were prepared, focusing on our client’s rehabilitation, insight into the offending and the significant progress made since the charges were laid.
The Local Court imposed an Intensive Correction Order (ICO) to be served in the community, allowing our client to avoid full-time imprisonment while continuing employment, rehabilitation and family responsibilities.
