A 26-year-old male engaged EAS Legal after being charged with Trafficking a Drug of Dependence and Possessing a Drug of Dependence following the execution of a search warrant at his home.
The prosecution alleged that text messages, cash and drug paraphernalia established commercial drug trafficking. Following a detailed review of the evidence, we identified significant weaknesses in the prosecution’s ability to prove trafficking beyond reasonable doubt and prepared comprehensive written representations addressing the deficiencies in the case.
Outcome: Following negotiations at a Summary Case Conference, the prosecution withdrew the trafficking charge, with our client resolving the remaining possession charge by way of a non-conviction outcome, avoiding the significant consequences associated with a trafficking conviction.
