EAS Legal recently represented a 64-year-old man at the Sunshine Magistrates’ Court who was facing several criminal charges, including the serious offences of Recklessly Causing Serious Injury and Common Law Assault.
Given the nature of the allegations, our client was understandably concerned about the potential consequences of the proceedings and, in particular, the prospect of a criminal conviction.
Our Criminal Law team carefully reviewed the prosecution case and engaged in negotiations regarding the charges being pursued against our client.
Following arguments advanced on our client’s behalf, the prosecution ultimately agreed to withdraw the most serious charges, including Recklessly Causing Serious Injury and Common Law Assault.
This substantially reduced the seriousness of the case that ultimately proceeded before the Court.
At the plea hearing, our team made detailed submissions addressing our client’s personal circumstances, the circumstances surrounding the offending and the appropriate sentencing outcome.
The Sunshine Magistrates’ Court ultimately agreed to deal with the remaining matter by way of a Good Behaviour Bond without conviction.
The result was significant for our client. Despite initially facing multiple charges, including serious assault-related offending, the most serious allegations were withdrawn and the proceedings were ultimately finalised without a conviction being recorded.
This outcome highlights the importance of carefully reviewing the charges and prosecution case before entering a plea. Effective negotiations can significantly alter the case that ultimately comes before the Court, while thorough plea preparation can make an important difference to the final sentencing outcome.
