Wyndham Magistrates’ Court – Family Violence Intervention Order Varied to Allow Father to Reconnect with His Children

EAS Legal represented the respondent to a Family Violence Intervention Order at the Wyndham Magistrates’ Court, where the existing conditions were preventing our client from maintaining a relationship with his children. We reviewed the conditions in detail and negotiated strategically with the other parties, arguing the restrictions went further than necessary and that safe communication about the children served their best interests. The order was varied and the conditions reduced to a Safe Contact Order, allowing our client to reunite with his children while appropriate safeguards remained in place.

Case Overview

Charge: Family Violence Intervention Order

Client: Anonymous client

Court Location: Wyndham Magistrates’ Court

At EAS Legal, we recently represented a client before the Wyndham Magistrates’ Court who was the Respondent in a Family Violence Intervention Order (FVIO).

Our client was not supportive of the existing Intervention Order, as the conditions were significantly impacting his ability to maintain a relationship with his children. While the order remained in place, the restrictions created substantial barriers to communication and family reunification.

Understanding the importance of preserving meaningful parent-child relationships where appropriate, our office worked to achieve an outcome that balanced the need for protection with the practical realities of co-parenting.

Our Approach

From the outset, we undertook a detailed review of the existing conditions and engaged in strategic negotiations with the other parties.

Our focus was on:

  • Demonstrating that the existing conditions were more restrictive than necessary in the circumstances;
  • Highlighting the importance of allowing the parties to communicate safely regarding the children;
  • Advocating for an outcome that promoted the best interests of the children while maintaining appropriate safeguards; and
  • Working towards a practical resolution that avoided unnecessary litigation.

Through careful negotiation and advocacy, we were able to present a solution that addressed the concerns of all parties.

The Outcome

Following our intervention:

  • The Intervention Order was varied
  • The conditions were reduced to a Safe Contact Order
  • Our client was able to reunite with his children
  • The parties were able to communicate and maintain family relationships within the framework of the revised order.

This was an excellent outcome for our client, allowing him to rebuild and maintain his relationship with his children while complying with the Court’s orders.

Why This Result Matters

Family Violence Intervention Orders can have a profound impact on parenting arrangements and family relationships.

While protecting those at risk is paramount, it is equally important that Intervention Orders are appropriately tailored and do not impose restrictions beyond what is necessary.

This case demonstrates the importance of:

  • Strategic negotiations;
  • Practical, child-focused advocacy;
  • Seeking variations where circumstances justify a less restrictive outcome; and
  • Ensuring Intervention Orders facilitate, rather than unnecessarily hinder, safe family relationships.

At EAS Legal, we understand that every family is different, and we work to achieve outcomes that protect our clients while preserving important family connections wherever possible.
