Wyndham Magistrates’ Court – Serious Assault Charges Significantly Reduced Following Strategic Negotiations

EAS Legal represented a 47-year-old man at the Wyndham Magistrates’ Court on multiple serious assault charges arising from an alleged road rage incident, with a criminal conviction and substantial penalty at stake. We conducted a forensic review of the prosecution brief and negotiated extensively before the matter was finalised, securing the withdrawal of several of the more serious charges and significant amendments to the Summary of Facts, with prejudicial material removed. Sentenced on a narrower and more accurate factual basis, our client received a good behaviour bond without conviction.

Case Overview

Charge: Assault

Client: 47-year-old male

Court Location: Wyndham Magistrates’ Court

At EAS Legal, we recently represented a 47-year-old male client before the Wyndham Magistrates’ Court who was charged with multiple serious assault-related offences arising from an alleged road rage incident.

The allegations were serious and exposed our client to the prospect of a criminal conviction and a substantial penalty. Had the matter proceeded on the original charges and facts, the sentencing outcome would likely have been significantly more severe.

Recognising the seriousness of the allegations, our office immediately commenced a detailed review of the prosecution brief and the available evidence.

Our Approach

Our team undertook a forensic analysis of the prosecution case and engaged in extensive negotiations with the prosecution prior to the matter being finalised.

Through these negotiations, we successfully argued that aspects of the prosecution case should be reconsidered. As a result, we were able to secure:

  • The withdrawal of several of the more serious charges;
  • Significant amendments to the Summary of Facts, removing and redacting material that was prejudicial to our client; and
  • A far more balanced factual basis upon which the Court was ultimately asked to sentence our client.

By narrowing the issues and ensuring the Court sentenced our client on a more accurate and proportionate set of facts, we significantly improved our client’s position.

The Outcome

Following our negotiations and sentencing submissions, the Court imposed:

  • Without conviction Good Behaviour Bond
  • No criminal conviction recorded
  • Several serious charges withdrawn
  • Summary of Facts substantially amended in our client’s favour

This was an exceptional outcome given the seriousness of the original allegations and the potential consequences had the matter proceeded on the initial charges.

Why This Result Matters

Many criminal matters are won long before sentencing.

Careful analysis of the prosecution case, strategic negotiations, and ensuring the Court sentences a client on an accurate factual basis can have a profound impact on the final outcome.

This case demonstrates the importance of:

  • Early intervention;
  • Challenging the prosecution case where appropriate;
  • Negotiating both the charges and the Summary of Facts; and
  • Presenting strong sentencing submissions focused on achieving the best possible outcome.

At EAS Legal, we understand that even small changes to the charges or facts can make a significant difference to the ultimate sentence imposed.
